Under the Tax Cuts and Jobs Act (TCJA), the estate and gift tax exemption was doubled for tax years 2018 through 2025. In 2024 individuals can leave their heirs up to $13.61 million, minus any prior gifts made during life, without federal estate tax liability. As of January 1, 2026, this federal estate and gift tax exemption will be cut in half, and adjusted for inflation, unless it is extended. Counsel must carefully consider planning strategies and estate plan modifications in light of the potential sunset of the gift and estate tax exemptions. This presentation will review critical planning considerations to reduce the value of the estate to minimize or avoid estate taxes.

Erika Hooker, Esq is an Associate Attorney in the Trusts and Estates and Agriculture Practice Groups. A native of the Central New York region and having grown up and worked in the agriculture community, Erika has a specific knowledge of succession planning for family farms. Cameron Bernard, Esq. understands that planning your estate can be a difficult task, especially where underlying family dynamics play a role. Cameron endeavors to learn about his client's values and goals to develop an estate plan that suits their needs. He also advises trustees in their administration of trusts and prepares fiduciary income tax returns for estates and trusts. Cameron's practice involves advising clients with respect to the design and implementation of pension and employee benefit plans, including tax-qualified retirement plans, 403(b) plans, non-qualified deferred compensations plans, cafeteria plans, and other fringe benefit plans. In addition to advising entities, Cameron also advises other attorneys and individuals with respect to the division of retirement assets upon divorce.
