The Texas Property Code recently welcomed a newcomer: the “purpose trust.” This article provides an overview of the developing area of non-charitable trusts without ascertainable beneficiaries by exploring the historical context of purpose trusts, as well as the Texas legislative history surrounding the new statute. By discussing specific estate planning examples, Selby aims to provide the audience with a framework to identify when purpose trusts may be helpful to clients. Learning objectives to include: An overview of the developing area of non-charitable trusts without ascertainable beneficiaries; The historical context of purpose trusts and the Texas legislative history surrounding the new statue; and, Identifying when purpose trusts may be helpful to clients.

Selby Rains is an Attorney at Law with Lisa Newman Law, PLLC in Dallas, TX. Selby focuses on representing individuals, families, and fiduciaries in estate planning, probate, estate and trust administration, succession planning for closely held businesses, entity formations, and wealth preservation. By working closely with wealth, insurance, and tax professionals to deliver comprehensive guidance and an array of legal solutions to meet each client’s specific needs, she advises clients regarding efficient wealth transfer and asset protection strategies that range from foundational death and incapacity planning for clients with smaller estates to sophisticated legal matters surrounding taxation and liability exposure for high-net-worth individuals and families.

Part II - ETF Total Cost of Ownership

Ryan Claybourn I Sales, ETF & Funds Management I Texas Capital

1 CFP, 1 CPA, 1 CIMA CE

Because an ETF can be bought and sold on an exchange like a stock and incurs trading costs, your TCO evaluation should include both trading and holding costs. Low fees do not naturally lead to low trading costs and, as a result, the lowest TCO. During this session, Ryan Claybourn delivers a unique perspective on how to evaluate ETFs through the eyes of explicit, implicit, and opportunity costs relative to the investment. The session will provide a deeper understanding of the cost structures within the ETFs, the three layers of liquidity associated with ETFs delivering accessibility for clients; and creating a due diligence process moving forward considering a deeper understanding of ETFs and how each cost can impact clients goals.

Ryan Claybourn currently helps to cover the Dallas/Ft. Worth territory for Texas Capital ETF & Funds Management. Prior to joining Texas Capital Ryan was an institutional trader for TD Ameritrade andSchwab. He currently resides in Ft. Worth, TX with his wife and four children.
